Agreement to Terms

By accessing and using the services of IR Light Designers, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Services Description

IR Light Designers provides professional lighting design and consultation services including but not limited to residential lighting design, commercial lighting consultation, landscape lighting design, LED retrofit solutions, architectural lighting, and hospitality lighting design.

Consultation and Design Process

Our standard process includes:

• Initial consultation to understand your needs and vision
• Site assessment and analysis
• Development of custom lighting design proposals
• Revision and refinement based on your feedback
• Final design documentation and specifications

Project timelines vary based on scope and complexity. We will provide estimated timelines during the consultation phase.

Fees and Payment

Service fees are outlined in individual project proposals. Payment terms typically include:

• Initial deposit upon project agreement
• Progress payments at designated project milestones
• Final payment upon project completion

All fees are quoted in US dollars. Additional costs for materials, fixtures, or installation may apply and will be clearly communicated.

Client Responsibilities

Clients are responsible for:

• Providing accurate information about project requirements and site conditions
• Obtaining necessary permits and approvals
• Ensuring site access for assessments and installations
• Timely review and approval of design proposals
• Payment according to agreed terms

Intellectual Property

All designs, plans, and documentation created by IR Light Designers remain our intellectual property until full payment is received. Upon full payment, clients receive a license to use the designs for the specific project location only.

Changes and Revisions

We include a specified number of design revisions in our project proposals. Additional revisions beyond the agreed scope may incur additional fees. Significant project changes may require a revised proposal and adjusted timeline.

Cancellation Policy

Either party may cancel the agreement with written notice. Cancellation terms:

• Deposits are non-refundable but may be applied to future projects within 12 months
• Work completed up to the cancellation date will be billed
• Clients retain rights only to designs that have been fully paid for

Warranties and Limitations

We warrant that our services will be performed with professional skill and care. However, we do not warrant:

• Performance of third-party contractors or products
• Specific energy savings or financial outcomes
• Results affected by factors beyond our control

Our liability is limited to the total fees paid for the specific project in question.

Confidentiality

We respect client confidentiality and will not disclose project details without permission. However, we reserve the right to use completed projects in our portfolio and marketing materials unless otherwise agreed in writing.

Dispute Resolution

Any disputes arising from these terms or our services will first be addressed through good-faith negotiation. If resolution cannot be reached, disputes will be resolved through binding arbitration in Hawaii under the rules of the American Arbitration Association.

Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective upon posting to our website. Continued use of our services constitutes acceptance of modified terms.
